These Terms of Use apply to access to betabace.com, the Betabace web application, the native iOS app and all functions, content and services made available through them. This includes in particular map views, search, route and area data, account areas, uploads, community data, editor workflows, 3D and image-processing functionality and optional paid features.

By accessing the platform, creating an account, signing in, uploading files, saving content or using paid features, you agree to these Terms. Mandatory statutory rights, in particular consumer protection rights, remain unaffected.

    2. Description of the service and platform nature

Betabace is a digital platform for climbing-related geo information, route and area content, community contributions, map views, uploads, profiles, editor workflows and technical add-on functions such as 3D rendering or photogrammetry processing. In material parts, the platform operates as a hosting and presentation service for user-generated content.

    • displaying and searching areas, places, routes and related information
    • creating, editing and storing route, area and community entries
    • managing account information such as name, handle, avatar and preferences
    • uploading, storing, linking and technically processing images or other files
    • using technical add-on functions such as route editors, 3D representations or photogrammetry
    • accessing optional premium or subscription-based functionality where offered

No claim exists to the continued availability of specific features, data models, map providers, integrations or file formats except where expressly agreed or mandatorily required by law.

    3. Registration, accounts and access credentials

Certain features require a user account. You must provide accurate, current and non-misleading information when registering and using the platform. Credentials, login links, one-time codes and comparable authentication data must be kept confidential and protected against unauthorised access.

You are responsible for actions carried out through your account to the extent they are attributable to your sphere of responsibility. If you suspect unauthorised access, misuse or compromise, you must inform us without undue delay and take reasonable protective measures.

We may restrict registration, access or individual account functions where there are concrete indications of false information, identity deception, abusive duplicate accounts, spam, security risks or other material breaches of these Terms.

    4. Profiles, handles and unregistered mentions

Where the product allows it, you may use a display name, handle, profile image and additional profile information. These identifiers must be legally permissible and must not infringe third-party rights or create a misleading impression of official, verified or third-party identity.

    • no unlawful, abusive, discriminatory or obviously confusing handles
    • no impersonation of authorities, companies, organisations or other persons
    • no profile images or profile information for which you lack the necessary rights or which infringe third-party rights

Betabace may also allow structured references to unregistered persons, for example route setters, first ascensionists, authors or other involved persons. Such mentions may only be created or used where they are factually supportable and there is a sufficient legal basis for naming the person concerned.

We may remove, rename, merge, unlink, correct, limit or block handles, profile fields, profile images or unregistered mentions where this is necessary for legal compliance, safety, transparency, abuse prevention or platform integrity. Affected persons may contact us to request review, correction or deletion.

    5. User content, responsibility and platform licence

If you upload, publish, store or link content on Betabace, including route information, area data, images, comments, geo data, descriptions, handles, avatars or other contributions, existing rights generally remain with you or the relevant rights holder. You are generally responsible for the legality, substantive accuracy and permissibility of your content.

You nevertheless grant us a non-exclusive, worldwide, transferable and sublicensable licence to host, store, reproduce, technically process, convert, compress, generate previews from, display, distribute within the platform and integrate your content into search, map, moderation, security, documentation, backup and platform-related presentation functions to the extent necessary for operation, maintenance, abuse prevention, legal enforcement and further development of the service.

This licence is limited to what is necessary for operation, maintenance, safeguarding, moderation, interoperability and further development of the platform. Limited storage may continue after deletion where content remains in backups, is linked to other records, must be retained for evidentiary reasons or is subject to legal retention obligations.

    • you confirm that you are entitled to provide the uploaded or published content
    • you must not upload content that infringes copyright, trademark, privacy, personality or other third-party rights
    • you must not publish obviously false or dangerously misleading safety-related information
    • if content contains personal data of third parties, you are responsible for ensuring that a valid legal basis exists

    6. Notice of illegal content, moderation and enforcement

Reports concerning allegedly illegal content, rights violations or material breaches of these Terms can be submitted to contact@betabace.com. A useful notice should identify the content concerned, its location, the reason for the complaint and contact details for follow-up.

We review incoming notices diligently and may, depending on the circumstances, leave content available, label it, restrict its visibility, de-list it, block it or remove it, and may take corresponding account-level measures. Where required by law, we will inform affected users of the main reasons for a measure and available remedies or contact routes.

We may review content proactively or in response to specific triggers for compliance with law and these Terms and may use automated signals, technical detection, prioritisation systems and human review for that purpose. Except where the law provides otherwise, no right exists to exclusively automated or exclusively human decision-making under these Terms.

In the event of breaches, we may issue warnings, restrict content, withdraw editing rights, reduce visibility, block uploads, suspend accounts temporarily or terminate the user relationship for cause. Removed content may be retained on a limited basis for evidence, safety or legal reasons.

    7. Permitted use and prohibited conduct

The platform may only be used in accordance with applicable law, these Terms and the intended product functionality. The following are prohibited in particular:

    • unlawful, abusive, defamatory, discriminatory, pornographic or otherwise impermissible content
    • spam, scams, automated mass requests or abusive lead generation
    • automated scraping, extraction or circumvention of technical access controls without permission
    • uploading malware, destructive code or technically manipulative files
    • publishing fabricated facts, manipulated safety data or intentionally misleading community contributions
    • using platform information to bypass lawful access restrictions, property rights or environmental protections

    8. Special rules for uploads and photogrammetry

Files uploaded for image-based or photogrammetry-related workflows may only be used if you hold the necessary rights and if their processing is technically and legally permissible. You are responsible for ensuring that no third-party rights are violated and that no sensitive or prohibited content is processed without a valid basis.

    • no unauthorised photos of identifiable people
    • no confidential or secret material without authorisation
    • no files whose processing infringes property, privacy or intellectual property rights
    • no abusive uploads intended to overload storage or compute resources

We may technically inspect, scan, validate, compress, transcode, generate previews from and technically process metadata of uploaded files or reject files for security, integrity or compatibility reasons where necessary for operation of the platform.

    9. Safety, outdoor risks and personal responsibility

Climbing, bouldering, approaches, abseiling and other outdoor activities are dangerous. Information on Betabace is not a safety guarantee and does not replace your own assessment, local knowledge, training, equipment, supervision or qualified instruction.

Grades, route descriptions, GPS references, topo-like depictions, 3D visualisations, route suggestions, weather-related information, community comments, protection references and other safety or access information may be incomplete, outdated, misleading or incorrect.

    • always verify protection, approach, access, weather, closures and local conditions yourself
    • respect property rights, environmental restrictions and local access rules
    • do not blindly rely on pins, markers, grades, 3D scenes or community statements
    • if you have doubts about safety, access or your own ability, do not attempt the climb

    10. Paid services, subscriptions, withdrawal and cancellation

Where Betabace offers paid features or subscriptions, the prices, billing intervals, durations, cancellation rules and service descriptions displayed at checkout, at the time of contract formation or in the user account apply in addition to these Terms. Payments are processed by the payment provider shown at checkout, currently Stripe for web payment flows. If paid digital features are later offered through an app marketplace, its payment, cancellation and refund rules may also apply.

You must keep relevant payment information up to date and pay amounts due on time. We may restrict or suspend paid functionality where payments fail, chargebacks occur, misuse is suspected or serious contractual breaches exist, to the extent permitted by law.

Statutory withdrawal rights of consumers remain unaffected. Where a withdrawal right exists, you will receive separate withdrawal information during the order process. To the extent permitted by law, a withdrawal right for digital content or digital services may expire early if you expressly consent to performance beginning before the withdrawal period ends and acknowledge the resulting loss of the withdrawal right.

Statutory cancellation rights and any legally required cancellation button remain unaffected. Where technically provided, subscriptions may additionally be managed through the user account or the Stripe or platform functions shown for that purpose.

    11. Changes to the service, updates and availability

We aim for high platform availability but do not owe uninterrupted or error-free access. Maintenance, updates, security measures, outages at hosting, map, authentication, storage, compute or payment providers and technical changes may lead to temporary restrictions.

We may modify, develop, limit or discontinue features, interfaces, data models, map providers, integrations, file formats and technical workflows where there is a valid reason, such as security, legal compliance, abuse prevention, operations, provider changes or product development.

Where Betabace provides consumers with digital products or continuously supplied digital services for payment or under a corresponding contract, mandatory statutory rights, in particular under sections 327 et seq. of the German Civil Code, remain unaffected. In such cases, detrimental changes will only be made within the limits of applicable law and with any legally required information.

    12. Duration, suspension, termination and effects of ending use

You may stop using the platform at any time. Where a user account exists, its deletion may be requested through the provided functions or by contacting us, subject to legal retention obligations, legitimate security interests and technical limitations relating to backups or connected records.

We may suspend accounts or individual features temporarily or permanently or terminate the user relationship for cause where there are concrete indications of misuse, rights violations, security threats, spam, payment problems, deceptive identity practices or other material breaches of these Terms. Where possible, we take into account the severity, frequency and context of the violation when selecting and calibrating measures.

After termination, content may be deleted, anonymised, depersonalised, unlinked, archived or retained on a limited basis where this is required because of backups, technical necessity, evidentiary purposes, legitimate interests of other users or legal obligations. Payment claims already due and rights and obligations that by their nature survive termination remain unaffected.

    13. Liability and mandatory statutory rights

We are fully liable for intent, gross negligence and damages arising from injury to life, body or health. In the event of slight negligence involving a breach of essential contractual obligations, we are liable only for the foreseeable damage typical for the contract. Otherwise, liability is excluded to the extent permitted by law.

Mandatory statutory rights of users, in particular under sections 327 et seq. of the German Civil Code and other mandatory consumer protection provisions, remain unaffected.

To the extent permitted by law, we do not assume liability or provide any warranty for the accuracy, completeness or suitability of user-generated content, community-maintained route information, external map, weather, search or geo data, grade information, approach descriptions, safety references, 3D visualisations or the consequences of your own climbing or outdoor decisions.

    14. Indemnity

You shall indemnify us against third-party claims arising from unlawful use of the platform attributable to you or from content you have provided, including reasonable legal defence costs, to the extent you are responsible for the violation.

    15. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of your country of habitual residence provide otherwise. If you are a merchant, legal entity under public law or special fund under public law, the place of jurisdiction is the provider's registered seat where legally permissible.

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected.

    Mobile app and Contributors supplement

This supplement forms part of the Terms of Use and applies in addition to sections 1–15 above.

A.1 Sign-in providers and mobile app use

Depending on the platform, you may sign in by email, Google or Apple. Your use of a third-party sign-in provider is also subject to that provider's terms and privacy rules. Betabace never asks for your Google or Apple password. You must not bypass authentication, device-security or platform controls.

The iOS app may request camera, microphone, speech recognition, location, background location or motion permission for features you deliberately use. You remain in control of these permissions through iOS Settings. Disabling a permission may disable the corresponding feature.

A.2 Route scans, recordings and local device data

Route scans, beta recordings and approach tracks may contain identifiable people, voices, precise locations or private-property information. Before recording, uploading, sharing or contributing this material, you must have the necessary permissions and respect local rules, privacy rights, property rights and access restrictions.

Some drafts, recordings, saved items and offline resources are stored locally on your device. You are responsible for maintaining appropriate device access controls and backups. Uninstalling the app or deleting local data may permanently remove local-only content. A private account backup or submitted contribution is separate from its local copy and must be deleted through the relevant account or service function.

    A.3 Approach recording and navigation

Automatic background approach recording is optional. If enabled, it may start when the device detects walking or running near a climbing area. Detection, maps, routes and directions can be inaccurate, incomplete or unavailable and are not emergency, rescue or safety services. Always assess access, terrain, weather, closures and personal safety independently.

    A.4 Betabace Contributors

Credit or attribution for a route, scan, image, approach or other contribution does not by itself create a right to payment, ownership of the underlying climbing route or an employment, agency or partnership relationship. If you join Betabace Contributors, eligibility, accreditation, revenue sharing, identity verification, taxes, Stripe Connect onboarding, payout timing, reversals and removal from the program will be governed by separate Contributor Terms presented before enrolment. Until those terms are accepted and the program activates a contribution, no payout promise is made.

    A.5 Account deletion

You may stop using Betabace at any time and request deletion of your account using the deletion function where available or by contacting contact@betabace.com. Deletion does not automatically cancel obligations or payment claims already incurred. Data may be retained only where required by law or where a narrowly limited legal, security or evidentiary reason applies; other content may be deleted, anonymised or detached from your identity as described in the Privacy Policy.
